Participation Agreement (Full Text)

By participating in activities at Second Sky, I acknowledge that interactive exhibits, climbing/play elements, workshops, and general use of the facility involve inherent risks. These risks may include, but are not limited to: slips, falls, collisions, equipment misuse, interaction with other guests, physical exertion, or environmental conditions. Participation is voluntary. I accept full responsibility for the risks associated with participation.

In consideration for being permitted to participate, I agree to release and hold harmless Second Sky, and its owners, directors, officers, employees, volunteers, contractors, and representatives from any and all claims arising out of or related to participation, except in cases of gross negligence or willful misconduct. This includes claims for injury, illness, disability, death, or property damage.

I agree to indemnify and defend Second Sky and those acting on its behalf against claims, demands, damages, losses, or expenses (including reasonable attorneys’ fees) arising from my participation or the participation of minors under my supervision, including claims brought by third parties.

I affirm I am physically able to participate. Second Sky does not provide medical insurance for participants. In the event of emergency, I authorize emergency medical treatment as necessary and agree to assume responsibility for associated costs.

I agree any dispute related to this agreement or participation shall be governed by the laws of Arizona and filed in Arizona. If any provision is found unenforceable, the remaining provisions remain in full force and effect.

I understand that Second Sky may photograph, film, or otherwise capture activities that may include my likeness (and the likeness of minors under my guardianship).
My consent for photography and media use is indicated separately within this form.
